In 2006, Outten & Golden and its co-counsel filed Rosenberg et al. v. IBM, a class action lawsuit alleging IBM failed to pay overtime wages to a large group of IT professionals.

Specifically, the complaint charged that IBM illegally classified its employees who install, maintain or support computer software or equipment as “exempt” under federal and state labor laws so it did not have to pay them overtime.

In 2007, the parties settled the claims for $65 million. At the time, this was the largest overtime-related settlement in the tech industry.
