Age Discrimination

Being treated differently at work because of your age is a serious problem. If you've been unfairly targeted, treated differently, or passed over, we can help you understand your legal options.

Age discrimination can happen at any time, from the job application and onboarding process to the way you’re assigned work and evaluated for it, to terminations.

You may notice that a company only hires younger employees. Job postings that cap years of experience—such as requiring only one to three years—or use phrases like “recent college graduate” or “digital native” can also signal a preference for younger applicants.

Another common scenario involves being pushed into early retirement. If your employer pressures you to retire or offers you an unfavorable early retirement package, this could be a sign of age discrimination.

Being demoted, fired, or passed over for a promotion can also be a devastating experience, especially after years of dedicated service. If you’re let go or replaced by a younger, less-experienced worker, it could be a sign of age discrimination.

We’re Here to Help

If you think you’ve been a victim of age discrimination, you don’t have to face it alone. We can help you understand your legal options and fight for the compensation and justice you deserve.

Framing the Issue

  • If you’ve read a job posting and paused because it felt like you weren’t the intended audience, you may be right. That’s because phrases like “recent graduate” can subtly signal age bias against older applicants.
  • Some employers also target online job ads to specific age groups, making you an unknowing victim of age discrimination.
  • You’re not alone if you’ve felt sidelined at work because of your age. Nearly two-thirds of adults over 50 have seen or experienced age discrimination on the job.
  • As the U.S. population increases, a higher percentage of Americans over age 65 remain in the workforce. Yet many older workers find that experience and dedication aren’t enough to overcome biased assumptions.

Notable Matters

  • With our co-counsel AARP, representing a class of RTX (Raytheon) workers, who allege the company routinely rejects and deters older candidates while giving preference to recent college graduates.
  • Secured $11.6 million for a nationwide group of PwC job applicants, who alleged the company engaged in systematic hiring discrimination against older accountants.
  • Represented the Communications Workers of America in the successful resolution of a lawsuit against Target, after the retail giant published social media job ads that were directed to younger workers, and not to older ones.
