Breach Of Contract

Outten & Golden attorneys represent employees whose employers have breached employment-related contracts and employees who have been accused by their employers of breaching such contracts. Outten & Golden lawyers often negotiate resolutions of these matters, enabling clients to avoid the expense and uncertainty of litigation. We have also successfully* litigated breach of contract cases in both arbitration and in federal and state court.

If an employer breaches an employment contract, the employee can sue for damages that arise as a result of the breach. Often the employment contract designates the forum in which the employee can enforce his or her rights; usually the chosen forum is arbitration. If there is no forum limitation in the contract, the employee can sue the employer in state or federal court for breaching the employment contract. Outten & Golden attorneys have had notable successes representing employees in breach of contract cases, including winning a $71.5 million arbitration award for breach of a profit participation plan — perhaps the largest arbitration award in an employment case.*
