If an employer breaches an employment contract, the employee can sue for damages that arise as a result of the breach. Often the employment contract designates the forum in which the employee can enforce his or her rights; usually the chosen forum is arbitration. If there is no forum limitation in the contract, the employee can sue the employer in state or federal court for breaching the employment contract.
