Outten & Golden LLP and Fair Work P.C. represent two former sales employees of LinkSquares, which sells legal and contract management software, in a proposed class and collective action for unpaid overtime wages under the Fair Labor Standards Act (FLSA) and Massachusetts state law.

The plaintiff filed this action on behalf of himself and other former and current sales representatives, including account executives. He claims that LinkSquares didn’t pay time-and-a-half when they worked more than 40 hours in a week because it misclassified them as exempt from overtime protections. The plaintiff alleges that sales representatives perform tasks such as prospecting and contacting potential clients, which don’t meet the legal test for an overtime exemption. Under the FLSA and Massachusetts law, workers are entitled to overtime wages unless an exemption applies.

This proposed class and collective action seeks overtime wages that LinkSquares sales representatives should have been paid.
