The Wiretap Act concerns the unauthorized recording of electronic communications while they are in transit. Generally employers may record employee communications, such as telephone calls, but as soon as an employer learns that the communications are personal, the employer must stop listening to and recording the communications. Employers sometimes violate the Wiretap Act by using spyware technology to track employees’ personal communications made via computer.
