Employment law attorneys are anxiously awaiting the U.S. Department of Labor’s update to regulations governing overtime-exempt status and closely monitoring how the department’s independent contractor proposal and its new tip credit rule will fare, promising to make 2023 consequential for wage and hour issues.

The DOL has repeatedly delayed a proposed reform to the regulations that define the executive, administrative and other white collar exemptions to overtime under the Fair Labor Standards Act, but attorneys told Law360 that they predicted the department will finally make progress on this foundational aspect of wage and hour law this year.
