Remote Work Means Pay Transparency May Be Borderless

The endurance of remote work, coupled with the proliferation of pay transparency laws, has led to a tricky compliance situation in which the option for workers to telecommute extends employers’ salary disclosure requirements beyond traditional borders, attorneys say.

Pay transparency laws differ by state and city but generally require employers to include pay scales in job postings or provide compensation information to job applicants and employees who inquire.

This movement to empower workers with pay information has gained traction at the same time that remote work has become a standard offering in many workplaces, raising questions about whether the laws cover would-be employees working from home in other jurisdictions.
