Downey v. Phenom People, Inc. Overtime Case

Outten & Golden LLP and Winebrake & Santillo, LLC represent two former sales employees of Phenom, which sells human resources and recruitment software globally, in a proposed class and collective action under the Fair Labor Standards Act (FLSA) and Pennsylvania state law. The plaintiff filed this action on behalf of himself and other former and current Sales Development Representatives (SDRs).

Plaintiff filed the collective and class action in the U.S. District Court for the Eastern District of Pennsylvania on September 27, 2023; the matter is captioned Downey v. Phenom People Inc., Case No. 2:23-cv-03781.

Plaintiff alleges that SDRs perform primarily non-exempt sales-related tasks, including prospecting and contacting potential clients as part of the sales cycle. Plaintiff claims that Phenom misclassified SDRs as exempt from overtime protections and failed to pay SDRs for overtime hours that they worked. In this action, Plaintiff seeks unpaid overtime wages and other relief on behalf of himself and other similarly situated SDRs.

The parties have entered into a settlement.
