Lamar Construction Company - $1.5 Million Class Settlement

On July 11, 2014, Outten & Golden filed suit against Lamar Construction Company ("Lamar") in the U.S. Bankruptcy Court for the Western District of Michigan seeking to recover 60 days wages and benefits for former employees under the Worker Adjustment and Retraining Notification ("WARN") Act. We contend Lamar ordered plant closings on or about July 9, 2014, without providing its employees with advance written notice.

On October 15, 2015, the Court granted final approval of a class settlement for the certified WARN class in an allowed priority amount of approximately $2 million, subject to the Chapter 7 Bankruptcy Estate recovering sufficient assets to fund the settlement in full.  The ultimate recovery and distribution to the class, inclusive of attorneys’ fees, was $1,554,622.   Settlement checks were mailed to the members of the class on January 31, 2019 by the Chapter 7 Trustee. Class members have one hundred and eighty (180) days from the date of issuance of the settlement checks to deposit or negotiate them.
