On April 29, 2009, Outten & Golden LLP and Fitapelli & Schaffer, LLP filed an amended class and collective action lawsuit in the United States District Court for the Southern District of New York against The Glazier Group Inc.; T-Bone Restaurant, LLC a/k/a Strip House New York; Peter H. Glazier; Penny Glazier; and Mathew Glazier for violations of federal and state wage and hours laws. The violations included: engaging in improper tip-pooling practices; redistributing portions of employees tips to non-tip eligible employees; failing to pay proper overtime compensation to employees who worked more than 40 hours in a work week; failing to reimburse workers for the cost of purchasing and laundering required uniforms; and failing to pay workers the required minimum amount of call-in pay for all days on which they report for duty. On December 13, 2011, the Court granted final approval of a class action settlement.
